Managed Subletting Scheme Terms & Conditions

These terms apply to any Managed Subletting Scheme offered by Away Resorts Limited and/or its group companies.  

Contact. We can only deal directly with the registered Owner of the Holiday Home. You hereby appoint Away Resorts as your exclusive agent for subletting your Holiday Home while participating in the Managed Subletting Scheme. 

Acceptance onto the Managed Subletting Scheme. Away Resorts’ decision to accept you onto any of our Managed Subletting Schemes is at our discretion and our decision is final. Continued acceptance onto any of our schemes is subject to you complying with your pitch licence agreement, Park Rules and these terms.  

Subletting dates. An Away Resorts team will introduce themselves to the Owner and confirm the agreed-upon subletting dates. You must provide your subletting availability for the following calendar year by 30 November each year. If not provided, the subletting schedule from the previous year will apply as a default minimum. 

Alterations to dates. Any changes to subletting dates requires prior written approval from an authorised Away Resorts Representative. For alterations to subletting dates please contact your Away Resorts Representative to check the availability of your Holiday Home. Any requests to change dates must be received in writing. If your Holiday Home is vacant, upon a minimum of 6 weeks’ notice, we would be happy to then reserve it for your own use. We will however not cancel any bookings in order to make your Holiday Home available for your use. Please make sure if you are private subletting or part of the Managed Subletting Scheme that you check your dates. Should your Holiday Home not be available, due to an error on your behalf, we may charge you the cost of the holiday. 

Force majeure. We shall not be liable for any bookings that are affected because the Park is closed, restricted or otherwise unable to operate holiday lettings as a result of events outside of our reasonable control (including, but not limited to, acts of God, war, terrorism, pandemic, epidemic (including but not limited to COVID-19 or similar public health events), governmental action or restriction, fire, flood, severe weather, or any other circumstance that renders the fulfilment of bookings impossible or impracticable – a Force Majeure Event). In the event that bookings are cancelled or otherwise affected due to a Force Majeure Event, such bookings shall be dealt with in accordance with our then-current guest booking terms and conditions. Where possible, we will endeavour to move the booking to an alternative date (subject to availability) or where it is not possible to move the booking, offer a refund to the guest in line with our policies at the time and any corresponding subletting income will be forfeited. For GIA Managed Subletting Schemes, during any period of disruption caused by a Force Majeure Event, we shall not be liable to pay any guaranteed subletting income and no compensation or alternative payments shall be due to the Owner in respect of such period. 

Obligations of Away Resorts. Away Resorts commits to: 

Conduct advertising and marketing across multiple platforms in relation to your Holiday Home; 

Provide a website with a live 24 hour online booking facility; 

Deal with all correspondence with guests and the general administration of all bookings;  

Clean your Holiday Home between sublettings; and 

Replace any subletting inventory, equipment, breakages and renew gas cylinders when empty (as per the terms below).  

Insurance. As Away Resorts is the acting agent for the Owner, it is the Owner’s responsibility to ensure that the Holiday Home is adequately insured against loss, damage and third-party liability (proof of such insurance will be requested by Away Resorts prior to commencement of any subletting and from time to time). 

Repairs and replacements. You must ensure that your Holiday Home remains in a condition compliant with the relevant subletting category and that it is clean and well-maintained, of modern design, and in a smart condition inside and out. We reserve the right to carry out all repairs and replacements to maintain the Holiday Home to the Away Resorts Subletting and Grading Standards and any damage to your Holiday Home will be charged to the Owner’s account, unless you are covered by the Repair Plan. If not, we reserve the right to complete repairs up to the value of £250 (inclusive of VAT) without giving you prior notification. If an Away Resort guest damages your Holiday Home, we will carry out the repair. If you are covered by the Repair Plan this will be completed free of charge up to the value of £250 (inclusive of VAT). If this amount is exceeded, the Owner will be required to claim on their insurance and Away Resorts will pay their insurance excess up to £250 (inclusive of VAT), otherwise this will be chargeable to the Owner. We will endeavour to match replacement items with existing styles or patterns, but this cannot be guaranteed, and we reserve the right to substitute as necessary. 

Personal belongings. All personal belongings must be removed from your Holiday Home prior to the commencement of any subletting. Failure to do so may result in your Holiday Home being withdrawn from the Away Resorts Managed Subletting Scheme. 

Inventory. You are required to equip your Holiday Home with a full standard inventory pack (to cover but not limited to kitchen, cleaning and dining equipment) for the full occupancy for the number of people it will sleep. For full details, please see the Holiday Home Standard Inventory Form. An Away Resorts Representative can help with queries and arrange for you to purchase inventory packs from us if required. 

Gas and electricity. Gas and electricity consumed during subletting periods shall be charged to your Owner account. All Owners must have gas and electrical appliances inspected through Away Resorts once a year for which there is a small charge. The appliances will be inspected in accordance with Away Resorts’ guidelines which are available at Owner Services. Electrical appliances will be repaired or replaced, if necessary, at the Owner’s expense. Any gas bottles must be stored outside the Holiday Home in an adequately ventilated, non-combustible area. Gas bottles must not be chained up or locked away. 

Keys. Three sets of keys will be charged to the Owner’s account prior to subletting and will be replaced free of charge if covered by the Repair Plan; otherwise, they will be charged at £7 per key if lost. 

Recording devices. The use of CCTV and doorbells that include a recording / live streaming facility whilst your Holiday Home is on the Managed Subletting Scheme is not permitted and must be disconnected. 

Statements. We send you a statement showing a breakdown of sublettings for the season in the form of a Statement of Account. For any Owners on a non-GIA Managed Subletting Scheme we aim to send statements, once per month. 

Facilities. A charge is made for access to facilities from Easter Holidays onwards, applicable to Sandy Balls, St Ives Bay, Tattershall Lakes and Whitecliff Bay only. This charge is retained by us.  

Non GIA Managed Subletting Scheme charges.  

For owners on non GIA Managed Subletting Schemes the price you receive in relation to the weeks you have sublet your Holiday Home are subject to deductions to cover our commission charges, changeover charges, facility access charges and hot tub management charges (as applicable)  and necessary for the wide range of discounts, reductions and part weeks which are essential for us to offer guests in order to achieve the maximum bookings for you. Such discount offers are made according to season and demand. 

VAT. Our commission charges, changeover charges and hot tub management charges are subject to VAT. Where a Holiday Home is sublet on behalf of an Owner the booking is subject to a deduction of VAT on the gross booking value. 

Following the deduction of the charges set out in paragraphs (a) and (b) above and VAT, all subletting income earned will be credited to your Owner account.  

Withdrawal of earnings. Should you wish to withdraw your sublet earnings please complete a Sublet Income Request Form and send this to your Away Resorts Representative. This is subject to your account remaining in credit. 

Termination. We may terminate the Managed Subletting Scheme any time if you fail to comply with these terms, or breach any of the terms of your pitch licence agreement and/or Park Rules. 

Repair Plan. Prior to being accepted on the Repair Plan, all items and repairs identified by the Park needing any attention must be completed prior to the commencement of any subletting. Any cost related to this will be the Owner’s responsibility.  

If you are not on a GIA Managed Subletting Scheme, a commitment of a minimum of 7 peak weeks is required to benefit from the Repair Plan. 

Repair Plan cover only applies during periods of subletting through Away Resort. The Park team will check for damage when cleaning the Holiday Home after the Away Resorts guest has departed.  

Please note that the Repair Plan cover does not cover damage to the fabric of the Holiday Home, such as external panels, exterior doors, windows or decking. You should claim against your Holiday Home insurance for these items. Normal wear and tear is not covered and is the Owner’s responsibility. 

Any damages or missing inventory items need to be reported within 24 hours of the Owner taking back occupation of the Holiday Home to be eligible for cover under the Repair Plan. 

The Repair Plan covers repairs and replacements up to the value of £250 (inclusive of VAT). If this amount is exceeded the Owner is required to claim on their insurance and Away Resorts will pay their insurance excess up to £250 (inclusive of VAT). 

General terms. Away Resorts may assign or transfer these terms and its obligations to another party, but you will be notified if this occurs. You may not transfer your participation in any Managed Subletting Scheme without Away Resorts prior written consent. No third party has any rights under these terms. If any term is found unenforceable, the rest shall remain in force. A delay in enforcing these Terms does not constitute a waiver of rights. 


Additional Terms for the 7 Year Guaranteed Income Agreement (GIA) Managed Subletting Scheme

The 7 Year GIA Managed Subletting Scheme enables Owners of qualifying brand-new Holiday Homes to earn a fixed income for letting their Holiday Home under the Away Resorts’ Managed Subletting Scheme.

Eligibility. The 7 Year GIA is only available on the purchase of a brand-new Holiday Home that meets the grading criteria of “Superior”, “Luxury”, or “Indulgent” as determined and confirmed by an authorised Away Resorts Representative. Holiday Homes must be purchased directly through Away Resorts to qualify for the 7 Year GIA. Away Resorts reserves the right to amend, suspend or withdraw the 7 Year GIA at any time without prior notice.

Minimum commitment. Owners must commit to the 7 Year GIA for a minimum of 2 full calendar years, after which the scheme will continue to roll forward on an annual basis unless terminated in accordance with section 7 below. You must make your Holiday Home available for a minimum of 6 letting weeks per calendar year to remain eligible.
Letting category requirement. To remain eligible for the scheme throughout the 7-year period, the Holiday Home must be sublet under the Away Resorts’ Managed Subletting Scheme and must be maintained in a condition that meets the Away Resorts Subletting Grading and Standards for Superior, Luxury, or Indulgent categories at all times. Away Resorts reserves the right to conduct periodic inspections to confirm ongoing compliance with the applicable letting category criteria.

Pitch availability. The 7 Year GIA is only available on selected pitches, as advised and approved by an authorised Away Resorts Representative. Pitch allocation is subject to availability and cannot be guaranteed until confirmed in writing by Away Resorts.

Commencement and duration. The scheme commences on the date of handover or written acceptance by Away Resorts and continues until 31 December of the following calendar year. Thereafter, these terms will continue to apply annually unless terminated in accordance with section 7.

Ending your participation in the 7 Year GIA. Either we or you or may terminate your participation in the 7 Year GIA by giving at least 6 weeks' written notice, to end on 31 December of the relevant calendar year. We may end your participation immediately by giving written notice if: (a) you are in serious or irremediable breach of these terms; or (b) you do not remedy a material breach within a reasonable time after being notified of it in writing.

Subletting dates already committed must still be honoured unless otherwise agreed by an authorised Away Resorts Representative.

Guaranteed subletting income (GSI). You are entitled to receive GSI only while these terms remain in force. The amount and payment schedule will be detailed in your personal guaranteed subletting breakdown. GSI is calculated by: (a) taking the relevant annual gross income rate for your Holiday Home category; and (b) deducting lost income due to: (i) any unlet weeks prior to purchase completion; (ii) weeks retained for your own use; and (iii) any outstanding advanced letting income from any prior GSI arrangements. The resulting figure is your fixed annual GSI, which will be credited to your Owner account in line with your pitch fee invoice. The amount credited is not affected by variations in pricing under Away Resort’s dynamic pricing model. The GSI replaces any prior subletting income arrangements, which are superseded by these terms.

Income. Any GSI will be credited to your Owner account to offset against pitch fee invoices only while you remain compliant with these terms.
